When pregnancy is the result of rape

The purpose of this ground, abortion, is to stop the effects of the consequences of the commission of a crime.

This situation arises when the pregnancy is the result of a forced sexual encounter or rape. In this case, abortion is an emergency health service and a right of survivors of sexual violence, to which they must have immediate access in all states across the country (General Victims Act and NOM-046-SSA2-2005).

The only requirement for a pregnant person to request an abortion from health services due to rape is to submit a written statement—handwritten or typed—in which she declares, under oath, that the pregnancy resulted from rape. Only when the pregnant person is under 12 years of age must the father, mother, or legal guardian submit the request (NOM-046-SSA2-2005).
