Article 243
In Tlaxcala there are six situations in which abortion is not punishable. These are established in Article 243 of the Penal Code for the Free and Sovereign State of Tlaxcala:
Article 243. The termination of pregnancy shall not warrant liability in the following cases:
– I. It is caused by the negligent conduct of the pregnant woman.
– II. The pregnancy is the result of the crime of rape.
– III. The pregnancy is the result of a non-consensual artificial insemination.
– IV. When the pregnant woman is in danger of death or serious damage to her health, in the judgment of the attending physician; hearing the opinion of another physician, provided that this is possible and the delay is not dangerous.
– V. When in the opinion of two medical specialists in the matter, who must give a separate and independent opinion, there is sufficient proof to diagnose that the product of conception presents serious genetic or congenital alterations, provided that the consent of the mother and father, as the case may be, is obtained.
