When a pregnancy results from rape or childhood sexual abuse
This situation occurs when the pregnancy is the result of a forced relationship or rape. In this case, abortion is an emergency health service and is a right of survivors of sexual violence, to which they should have immediate access in all entities of the country (General Law on Victims and NOM-046-SSA2-2005).
The only requirement for a pregnant woman to request an abortion before the health services due to rape is through a free handwritten or computerized document in which, under oath, she declares that the abortion is the result of rape. Only when the pregnant woman is under 12 years of age, the father, mother or legal guardian must make the request (NOM-046-SSA2-2005).
Article 4 of the Constitution.
Abortion is legal in Jalisco.
In Chiapas, abortion is a legal health service. You have the right to safe abortion and the law protects you. Local legislation guarantees the right to have an abortion at the free choice of the woman or pregnant woman during the first 12 weeks of gestation.
