When it is performed for medical reasons

 

This ground for termination applies when the healthcare professional treating the pregnant person, based on objective clinical criteria, determines that continuing the pregnancy will negatively affect the pregnant person’s health due to the presence of certain risk factors.

Article 1 BIS of the General Health Law defines health as a state of complete physical, mental, and social well-being, and not merely the absence of disease or infirmity. Determining when there is a risk to health is a medical matter, while the choice of whether or not to address that risk is a personal decision.

In this regard, the First Chamber of the Supreme Court of Justice of the Nation determined that the adequate and timely provision of abortion, when a physical, mental, or social health condition arises or worsens due to pregnancy, is a priority medical service that all health care institutions in the country are required to provide (SCJN, 2019).
