When the health (physical, mental or social) of the pregnant person is affected by the pregnancy

In this case, abortion serves to prevent serious harm or adverse effects on the health of the pregnant person. Article 1 BIS of the General Health Law defines health as a state of complete physical, mental, and social well-being, and not merely the absence of disease or infirmity. Determining when there is a risk to health is a medical matter, while the choice of whether or not to proceed is a personal decision. In this regard, the First Chamber of the Supreme Court of Justice of the Nation ruled that the adequate and timely provision of abortion, when a physical, mental, or social health condition arises or worsens due to pregnancy, is a priority medical service that all health institutions in the country are required to provide (SCJN, 2019).

“Everyone has the right to decide in a free and informed manner on the number and spacing of his or her children.”

Article 4 of the Constitution.
