Mexico
In Mexico, we work to ensure that all women and people who are able to bear children can make free decisions about their reproductive health.
We network with different organizations, join efforts in the prevention of unwanted pregnancies, access to contraception and safe abortion, and generate and disseminate information based on scientific evidence.
Legal Abortion in Mexico
In Mexico, abortion is regulated at the state level in local penal codes, under certain situations or conditions that release or exclude women or persons with the possibility of gestation from criminal liability.
Each of the 32 states establishes in its criminal legislation the circumstances under which abortion is legal in its territory. To date, the criminal laws of Mexico City, Oaxaca, Hidalgo, Veracruz, Baja California, Colima, Guerrero, Baja California Sur, Quintana Roo, Puebla, Jalisco, Michoacán, San Luis Potosí, Chiapas, Zacatecas, Estado de México, Nayarit, Campeche, Yucatan and Tabasco allow abortion at the request of the pregnant person up to 12 completed weeks of gestation, with the exception of Sinaloa which allows it up to 13 weeks and Aguascalientes which limits it to 6 weeks.
After these deadlines, local criminal laws contemplate some situations, called grounds, in which it is possible to have a legal abortion regardless of gestational age. These grounds are specified in the penal codes of each state.
