Legal Abortion – Chiapas

In Chiapas, abortion is a legal health service. You have the right to safe abortion and the law protects you.

In the state of Chiapas it is possible to legally terminate a pregnancy by free decision of the pregnant person up to 12 completed weeks of gestation.

Legal Interruption of Pregnancy (ILE)

In Chiapas, access to health services for the termination of pregnancy during the first 12 weeks of gestation, regardless of the reason for the termination, is legal. This is known as legal termination of pregnancy (ILE).

Abortion is a right and is performed by the free decision of the woman or pregnant woman. It is not necessary to provide an explanation of the reasons for the abortion within the first 12 weeks of gestation.

You can access the ILE through the pathway of your choice:

1. In the public health services of Chiapas
2. self-managing your procedure with medications
3. With a network of companions from your organization
As a right in Chiapas, abortion services should be provided like any other sexual and reproductive health service: in conditions of quality, safety and respect for girls, adolescents and people with the capacity to become pregnant, whether or not they are affiliated with the public health system, with guaranteed privacy and confidentiality.

In addition to abortion, in Chiapas there are other grounds for abortion to be legal.

In the state there are five other situations, called grounds, that allow people to request and access a safe abortion legally, without penalties and without abortion being considered a crime, regardless of the number of weeks of gestation.

Grounds are specific situations in which the law allows individuals to request a safe abortion procedure, regardless of gestational age. In these cases, health services and their personnel must support them in identifying and facilitating their care, without increasing the requirements indicated in the law or imposing obstacles or barriers to their access.

Health personnel are not obliged to report or denounce women or pregnant women who seek abortion services or who have attempted to terminate their own pregnancies. On the contrary, they are responsible for safeguarding, under standards of confidentiality, the information they receive about the health status of persons in the exercise of their profession.
