Article 1 BIS of the General Health Law defines health as a state of complete physical, mental, and social well-being, and not merely the absence of disease or infirmity. Determining when there is a risk to health is a medical matter, while the choice of whether or not to proceed is a personal decision. In this regard, the First Chamber of the Supreme Court of Justice of the Nation held that the adequate and timely provision of abortion, when a physical, mental, or social health condition arises or worsens due to pregnancy, is a priority medical service that all health institutions in the country are required to provide (SCJN, 2019).
